Terms & Conditions of Hire

These terms and conditions ("Terms") govern the hire of equipment and the supply of services by Moduhire ("we", "us", "our") to you, the customer ("you", "your"). Please read them carefully. By paying a deposit, confirming a booking or accepting delivery of equipment, you agree to these Terms.

1.Definitions

"Equipment" means the staging, flooring, scenic flats, plinths, furniture, lighting and any other items we agree to hire to you. "Hire Period" means the period from delivery (or collection by you) until the Equipment is returned to or collected by us. "Hire Charges" means the charges for the hire and any related services set out in our quotation.

2.Quotations & bookings

Quotations are valid for 30 days unless stated otherwise and are subject to availability at the time of booking. A booking is only confirmed once we have received your deposit and issued written confirmation. The contract between us is formed at that point and is made up of these Terms together with your quotation and booking confirmation.

4.Hire period

The Hire Period is set out in your quotation. If you keep the Equipment beyond the agreed period without our written agreement, additional Hire Charges will apply at our standard daily rate. Title in the Equipment remains with us at all times; you acquire only the right to use it for the Hire Period.

5.Delivery, set-up & collection

We will agree delivery, installation and collection arrangements with you in advance. You are responsible for ensuring safe, clear and suitable access to the site, including parking and any necessary permissions. If we are delayed or unable to deliver, install or collect due to access problems, unsafe conditions or no one being present at the agreed time, waiting time and re-attendance charges may apply.

7.Loss, damage & insurance

From delivery (or your collection) until return, you are responsible for the Equipment and for any loss, theft or damage beyond fair wear and tear, however caused, while it is in your care.

8.Cancellations & changes

If you need to cancel a confirmed booking, the following charges apply (calculated on the total Hire Charges), unless we agree otherwise in writing:

We will always try to accommodate date changes where possible. If we have to cancel due to circumstances beyond our control, our liability is limited to refunding sums you have paid for the affected booking (see clauses 9 and 11).

9.Our liability

We will provide the Equipment and services with reasonable care and skill. We are not liable for any indirect or consequential loss, or for loss of profit, revenue or opportunity. Except in respect of death or personal injury caused by our negligence, or any other liability that cannot be excluded by law, our total liability arising out of any booking is limited to the total Hire Charges paid for that booking.

10.Consumers

If you are a consumer, nothing in these Terms affects your statutory rights. Where the Consumer Contracts Regulations apply, you may have a right to cancel within 14 days of booking; however, if you ask us to begin the services (including reserving your date and Equipment) within that period, you may be charged for what has been provided up to the point you cancel.

11.Events beyond our control

We are not responsible for failure or delay in performing our obligations caused by events beyond our reasonable control, including severe weather, fire, flood, transport failure, strikes, or restrictions imposed by authorities. We will let you know as soon as possible and work with you to reschedule where practical.

12.Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
